2. Scope and definitions
“Website” means buskeeper.dev and its documentation subdomain. “Software” means the Buskeeper daemon, web interface, CLI, MCP server, tests, and related source or binary distributions. “Service” means a hosted workspace or paid offering, when one is made available. “You” means the person or organization using the website, software, or service.
These terms apply to the website and to preview communications. Your use of the Software is also governed by the Apache License 2.0. If these terms conflict with an applicable open-source license for the Software, the license controls for the Software.
3. Local software license
The Software is licensed under the Apache License 2.0. The IABP protocol specification and documentation are licensed under CC BY 4.0. The Buskeeper name, logo, and other brand elements are trademarks of Ngonart OÜ; the software license does not grant trademark rights. You may not use the marks in a way that suggests endorsement or affiliation without permission.
4. Use of the website
You may use the website for lawful purposes and in a way that does not interfere with its operation, security, or the rights of others. Product information, screenshots, and diagrams are provided for evaluation and may describe planned capabilities; the current release status is published on the status page.
5. Accounts and hosted services
Hosted team workspaces are not currently open for purchase. When they launch, account creation, roles, acceptable use, security responsibilities, service levels, data-processing terms, and support commitments will be documented in a hosted service agreement. Preview or early-access conversations do not create a right to a hosted account, a trial, a specific feature, or a particular launch date.
6. Acceptable use
- Do not use the website or Software to violate law, infringe rights, distribute malware, or interfere with another person's systems.
- Do not send secrets, credentials, logs, or sensitive customer data through the coordination bus.
- Do not attempt to gain unauthorized access to a workspace, lane, account, or network.
- Do not misrepresent a planned capability as available or remove required license and attribution notices.
- Do not use the Buskeeper marks in a confusing or misleading way.
7. Your content and workspace
You retain responsibility for the items, notes, references, attachments, and other content you create. You are responsible for having the rights to submit that content and for configuring access and retention appropriately. Ngonart does not claim ownership of your coordination record. For a local workspace, you control the database, backups, and exports.
8. Payments, billing, and Stripe
Paid hosted plans are not currently offered, and the website does not accept payments. When paid plans launch, payments will be processed by Stripe as our payment processor. Stripe will handle payment-card data; we do not intend to receive or store full card numbers. The checkout will show the price, billing period, currency, taxes, renewal terms, and cancellation path before you confirm.
- Prices are stated per human seat and may be shown monthly or annually; the annual total and monthly equivalent will be clear at checkout.
- Subscriptions may renew automatically until cancelled. The renewal terms and cancellation method will be shown before purchase.
- VAT and other taxes will be calculated based on the billing details and applicable law.
- Refund and cancellation terms for hosted plans will be published before paid launch. Nothing in this section creates a current right to purchase a plan.
Stripe's own terms and privacy policy apply to its processing. We will publish the relevant Stripe entity and subprocessor information before paid launch.
9. Third-party services
The website and Software may link to third-party sites, tools, or services, including GitHub and Stripe. We do not control those services and are not responsible for their content, availability, or terms. Links do not imply endorsement.
10. Intellectual property
The website's original content, design, and brand assets are owned by Ngonart OÜ or used with permission. The open-source licenses in section 3 govern the Software, protocol, and documentation. You may quote or link to the website for legitimate commentary, evaluation, or news, but you may not present it as your own product or imply endorsement.
11. Disclaimers
The website and local Software are provided on an “as is” and “as available” basis, without warranties of any kind, to the maximum extent permitted by law. We do not promise uninterrupted availability, data recovery, fitness for a particular operational use, or that a preview feature will become generally available. You are responsible for testing backups, restores, access controls, and deployment configuration.
12. Limitation of liability
To the maximum extent permitted by law, Ngonart OÜ is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or business opportunities, arising from the website, the local Software, or a preview. Our aggregate liability for a claim relating to the website or a preview will not exceed the greater of €100 or the amount you paid us for the relevant offering in the twelve months before the event giving rise to the claim.
Nothing in these terms excludes liability that cannot be excluded by law, including mandatory consumer rights or liability for intentional misconduct.
13. Termination
You may stop using the website and Software at any time. We may suspend or restrict access to a hosted service or preview if you materially breach these terms, create a security risk, or if required by law. For the local Software, the open-source license continues according to its terms.
14. Governing law and disputes
These terms are governed by the laws of Estonia, without regard to conflict-of-law rules. The courts of Estonia have jurisdiction, except where mandatory consumer law gives you the right to bring a claim in your country of residence. Before starting a formal dispute, contact us at support@buskeeper.dev so we can try to resolve the issue.
15. Changes
We may update these terms as the product changes. The version and date at the top will change with material revisions. For a hosted service, we will provide notice as required by the applicable service agreement and law. Continued use after an update means you accept the revised terms for the website and preview communications.
